Terms of Service

These Terms of Service ("Terms") govern access to and use of the AI Growth Kit website chat and automated phone-answering services (together, the "Service"), operated by Viggo Palenzona, sole proprietor ("we," "us," "our"). By signing up for, accessing, or using the Service, you ("Client," "you") agree to these Terms.
1. The Service
AI Growth Kit provides an AI-powered chat widget that businesses embed on their own website to answer visitor questions, qualify leads, and schedule appointments. When separately configured for a business, our automated phone assistant can collect caller and job details, check availability, book appointments during business hours, and capture callback details outside those hours. The service available to your business is the one agreed during onboarding; a product page alone does not activate phone answering. The Service integrates with third-party tools you or we configure on your behalf (currently Google Calendar and Google Sheets for scheduling and lead capture, and Stripe for billing).
2. Account & fees
Pricing, setup fees, and the monthly subscription rate for your account are as agreed in your onboarding conversation and reflected in your Stripe checkout/subscription. Fees are billed in advance on a recurring monthly basis and are non-refundable except as required by law or as we agree in writing.
Phone plans include the monthly minute allowance disclosed at checkout. The current offer includes 400 minutes per month, with additional minutes at $0.50 per minute. Usage charges are separate from the recurring base subscription and are reflected on the invoice. Standalone phone answering is $500 setup and $200 per month; both products together are $750 setup and $300 per month. Adding phone answering to an existing chatbot subscription is $250 setup, with the combined subscription becoming $300 per month. These are separate offers, not cumulative setup fees.
3. Term & cancellation
Your subscription runs month-to-month unless a different term was agreed in writing. Either party may cancel with written notice (email is sufficient); cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.
4. Your responsibilities
- You're responsible for the accuracy of the business information, services, pricing, opening hours, and policies the assistants are configured to represent on your behalf.
- You're responsible for reviewing captured leads, written call summaries, and appointment records, correcting inaccurate information, and following up with customers. Phone recordings and full call transcripts are not provided.
- You're responsible for keeping connected calendars, lead sheets, business hours, and phone routing accurate, and for arranging human follow-up and an appropriate fallback when the service is unavailable. You must provide any notices and obtain any permissions required for your use of the service.
- You won't use the Service for any unlawful purpose or to collect sensitive personal data from your customers beyond what's needed to schedule an appointment (name, contact information, service address, and stated need).
5. Our responsibilities
We'll use commercially reasonable efforts to keep the Service available, but we don't guarantee uninterrupted uptime. The Service depends on third-party providers (including Anthropic, Google, Stripe, Vapi, and configured telephony and speech providers); outages on their end are outside our control.
Phone answering is not an emergency response or dispatch service. Callers facing immediate danger should contact the appropriate emergency service rather than wait for a callback. The assistant does not guarantee answer speed, a callback deadline, or that every call or booking will succeed.
An appointment is confirmed only when the connected calendar accepts it. Changes to a phone booking are supported during the same call; changes or cancellations requested on a later call require the business to handle them. What the phone assistant does outside your business hours depends on the setting agreed at onboarding: it either continues to offer your next available appointment times, or stops offering times and captures callback details instead. It does not send a caller a confirmation email or text message.
6. Data
See our Privacy Policy for how visitor, caller, lead, and appointment data is handled. You retain ownership of the leads and appointment data captured through your account.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. AI-generated responses may occasionally be inaccurate; you're responsible for reviewing and correcting the assistants' configured information.
8. Limitation of liability
To the maximum extent permitted by law, our total liability arising from your use of the Service is limited to the fees you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or notice on this page. Continued use of the Service after a change constitutes acceptance.
